This matter is being taken up for hearing through video conferencing due to outbreak of the pandemic, COVID-19. This petition has been filed pleading defiance of order dated 18.07.2019 in CWP No.19343 of 2019 wherein the respondents have been directed to decide legal notice dated 28.06.2019 served by the petitioner, by passing a speaking order within a period of three months from the date of receipt of certified copy of the said order. There was no expression of any opinion on the merits of the case.
As per reply by way of affidavit dated 09.09.2021 of Mr. Dinkar Gupta, IPS, Director General of Police, Punjab, it is stated that order dated OMKAR SINGH 2021.12.09 16:34 I attest to the accuracy and integrity of this document High Court, Chandigarh
COCP No.1496 of 2021 [2] 18.07.2019 has been complied with. Speaking order dated 01.09.2021 has been passed wherein petitioner's claim for granting arrears qua revision of special family pension w.e.f. 01.12.2011 to 17.10.2017 amounting to `7,86,321/- has been considered and accepted. A sum of `6,00,000/- has been deposited in the bank account of the petitioner, details of which have been mentioned therein, after deducting the amount of tax.
It is noticed that none had appeared on behalf of the petitioner on the last date of hearing. Today, despite the matter being called twice, there is no representation on behalf of the petitioner. It appears that same is due to compliance of order dated 18.07.2019.
Rule is accordingly discharged.
In case of factual inaccuracies, if any, which may have been projected before this Court, the petitioner is at liberty to move an appropriate application in this petition.
