(ORAL) By way of instant appeal filed under Section 14-A of Scheduled Caste and Scheduled Tribes (Prevention of Atrocities Act), 1989, the appellant has laid challenge to the order dated 31.10.2023 passed by learned Additional Sessions Judge (Fast Track Special Court to try the Offences of Rape and Under POCSO Act), Kurukshetra whereby third application for regular bail under Section 439 Cr.P.C. in case FIR No. 741 dated 19.11.2022 registered under Sections 323, 365, 506 of Indian Penal Code, 10 and 12 of Protection of Children from Sexual Offences, 2012 and 3(1)(w), 3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities Act, 1989) at Police Station Krishan Gate, Thanesar, has been dismissed.

Custody certificate dated 30.04.2024 filed in Court today is taken on record, as per which, the appellant has undergone the custody period of 11 months and 4 days as an undertrial. After arguing for sometime, when this Court is not inclined to accord the benefit of regular bail to the appellant, learned counsel submits DIVYANSHI 2024.05.01 14:43 I attest to the accuracy and integrity of this document
