(Oral) This petition under Section 482 of the Code of Criminal Procedure is for setting aside the orders dated 01.06.2016 and 09.09.2016 (Annexures P-4 and P-7), passed by Additional Sessions Judge, Rewari, vide which the petitioner was directed to make the payment of arrears of maintenance.
Learned counsel for the petitioner has referred to the order dated 19.04.2016 whereby it has been observed that the question whether the child Laxya as per DNA report is of the respondent (petitioner herein) and all the arguments advanced by him would only be decided at the final stage of the trial.
Keeping in view the specific stand taken by the petitioner, the order dated 01.06.2016 (Annexure P-4), at this stage, is modified to the Naresh Kumar 2016.09.26 16:18 I attest to the accuracy and integrity of this document Chandigarh extent that the petitioner shall deposit the entire maintenance amount before
CRM-M-33394-2016 -2the trial Court, within a period of one week from the date of receipt of certified copy of this order and thereafter the same will be disbursed to respondent No.3 (wife), at the time of final decision of petition filed under Section 125 Cr.P.C.
In view of the above, the present petition stands disposed of accordingly.
