The Family Court has held that the petitioner is entitled to maintenance pendente lite@ ₹20,000/- per month as she is looking after the minor son.

It has come in evidence that the respondent is a Chartered Accountant, presently working as a Director in KPMG Global Services Private Limited, Delhi. His annual income is ₹50,61,127/- plus additional average pay of ₹8,93,252/-. Hence, his monthly income works out to ₹5,00,000/- per month. The petitioner wife is drawing a salary of ₹22,000/- per month (approximately).

It is obvious that the Family Court has erred in assessing the maintenance pendente lite @ ₹20,000/- per month only. Keeping in view the aforesaid facts, the order passed by the Family Court is modified. The respondent-husband shall be liable to pay the maintenance pendnte lite @ ₹1,50,000/- per month from the date of filing of the application.
