(ORAL) This is a petition that has been filed for grant of regular bail to the petitioner in FIR No.433 dated 12.12.2020 registered under Sections 392, 394, 397, 201 IPC at Police Station Sector 50, Gurugram. Counsel for the petitioner herein would contend that in fact the allegations as set out in the FIR are patently false. The petitioner herein had taken a friendly loan from the father of the complainant and was returning the same, as would be evident from the bank statements. However, when the loan was repaid and the petitoiner asked for return of the security cheques, a minor scuffle took place and wrong charges of aggravated assault have been levelled against the petitoiner. It is argued that the investigation has been completed and the challan stands presented and therefore, custodial interrogation of the petitoiner would no longer be required.

CRM-M No.20788 of 2021 (O&M) -2regular bail to the petitioner by contending that no ground for grant of bail is made out keeping in the seriousness of allegations levelled against him. I have heard learned counsel for the parties. Keeping in view the fact that the matter stands investigated and the trial is likely to take some time to conclude owing to present COVID-19 pandemic situation, no useful purpose would be served in keeping the petitioner behind bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
