In the instant petition under Section 482 Cr.P.C., prayer has been made for quashing of FIR No. 0194 dated 15.07.2018 (Annexure P-12) under Section 380 IPC , Police Station Division No. 6, Ludhaina, registered against the petitioner by respondents No. 5 and 6, in conspiracy with certain builders.

An FIR registered by the police cannot be quashed without investigation. Therefore, in the fitness of things, this petition is disposed of with a direction to the petitioner to move a representation raising all the pleas as raised herein before respondent No. 3-Commissioner of Police, Ludhiana, within a week from today. On doing so, respondent No. 3Commissioner of Police, Ludhiana, is directed to look into the matter and decide representation of the petitioner, in accordance with law, by passing a speaking order and after affording an opportunity of hearing to him, within a period of one month from the date of receipt of representation, if any, moved by the petitioner.
