The instant petition has been filed on behalf of the petitioner seeking grant of regular bail in respect of aforementioned FIR. 2.
The allegations, in nutshell, are that the petitioner as well as her husband had entered into the house of the complainant who is a neighbour and had caused injuries to her. It is alleged that while the petitioner caught hold of the complainant from her hair and hit her against the wall, her husband gave fist blows and blows with 'stick'. 3.

CRM-M-17782-2024 (O&M) - 2 - 2024:PHHC:054157 to her is that she had caught hold of the complainant from her hair. It is alleged that although the petitioner is alleged to have hit the complainant against a wall, but the said allegations are not substantiated inasmuch as there is no MLR.

Opposing the petition, learned State counsel submitted that it is a case where the petitioner had been granted bail initially but she jumped bail and remained proclaimed offender for about 2 years. It has however, been informed that after the re-arrest of the petitioner she has presently been in custody since the last more than 2 months and 13 days and that she is otherwise not involved in any other case. 5.
Learned counsel for the complainant while opposing the petition has submitted that having regard to the manner in which the injuries were caused to the complainant no case for grant of bail is made out. 6.
This Court has considered the rival submissions. 7.
Having regard to the fact that it is a case pertaining to bailable offences and the petitioner is a lady having a clean record, this Court is of the opinion that a lenient view may be taken in the matter. The petition, as such, is accepted and the petitioner is ordered to be released on regular bail on her furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
