(ORAL) The present petition has been filed by the petitioner under Section 439 of the Code of Criminal Procedure, 1973, for grant of bail pending trial in case FIR No.593 dated 14.12.2020 registered under Sections 380, 457 and 413 of the Indian Penal Code, 1860, at Police Station City Tohana, District Fatehabad.

It is submitted by the learned counsel for the petitioner that the case against the petitioner is totally concocted. The petitioner has been involved in the present case only because he was facing some other cases as well. However, in all other cases, the petitioner has already been released on bail. Not only that, in the present case also, the co-accused of the petitioner with similar allegations has already been released on regular bail by this Court. 2023:PHHC:094439 CRM-M-18050-2023 -2required for any investigation purposes. Hence, the petitioner deserves to be released on bail pending trial.

On the other hand, learned counsel for the respondent-State, on instructions from ASI Vinod Kumar, has submitted that the petitioner is habitual of committing this kind of crime. The petitioner is involved in 17 more cases of similar nature. However, it is not disputed that the petitioner has been released on bail in all those cases and even in the present case, the co-accused of the petitioner with similar allegations and having other criminal cases like the petitioner, has already been granted concession of bail pending trial. It is also not disputed that the petitioner is in custody since 22.07.2021.

In view the above, but without expressing any further opinion on the merits of the case, the present petition is allowed. The petitioner is ordered to be released on bail pending trial subject to his furnishing bail bonds/surety to the satisfaction of the Trial Court/Duty Magistrate, concerned.
