NARESH KUMAR SANGHI, J (Oral) Prayer in this petition, filed under Section 438, Cr.P.C., is for grant of anticipatory bail to the petitioner, Tarsem Singh, son of Ramesh Singh, resident of village Kallu Sohal, Tehsil Batala, District Gurdaspur, who has been booked for having committed the offences punishable under Sections 148, 323, 324, 326 and 452 read with Section 149, IPC, in a case arising out of FIR No. 94, dated 28.6.2015, registered at Police Station, Civil Lines, Batala, Police District Batala, District Gurdaspur.
Learned counsel contends that as per the medical report, the injury on the left leg of the injured was superficial in PRASHANT KAPOOR 2015.09.23 17:29 I attest to the accuracy and authenticity of this document
CRM-M-32560-2015 nature and, as such, it cannot be termed as grievous. He further submits that it was a case of version and cross-version and that the a dispute between mother and daughter has resulted into false implication of the petitioner, who is the brother-in-law (Jija) of the injured.
I have heard learned counsel for the petitioner and with his able assistance gone through the material available on record. X-ray report (Annexure P-2), dated 25.6.2015, issued by the Medical Officer would reveal that Injury No. 1, i.e. on the left leg of the injured, was declared as grievous, attracting the mischief of Section 326, IPC. The said injury was alleged to have been caused by the petitioner by means of Dattar.
No ground for grant of anticipatory bail to the petitioner is made out.
Dismissed.
