(ORAL) Learned counsel for the petitioner argues that though, against the impugned order dated 12.04.2021 (Annexure P-15), the petitioner has already preferred an appeal before the Board of Directors on 07.05.2021 (Annexure P-16), but without deciding the said appeal, the impugned order of punishment is being implemented. Learned counsel for the petitioner submits that the petitioner is being caused prejudice on both the accounts as on one hand recovery has been started against him on the basis of impugned order and secondly his appeal is also not being decided. Learned counsel for the petitioner submits that petitioner will be satisfied, at this stage, in case a time bound direction is issued to respondent No.2 to decide the appeal dated 07.05.2021 (Annexure P-16). Mr. Sharad Aggarwal, AAG, Haryana, who has joined the proceedings through video conference, keeping in view the service of advance copy of petition, accepts notice on behalf of respondent-State and raises no objection with regard to prayer of the petitioner for deciding the appeal dated 07.05.2021 (Annexure P-16) by respondent No.2 in a time bound manner by passing an appropriate speaking order. In view of the above, without expressing any opinion on the merits of the case or the claim being made by the petitioner, respondent No.2 is directed to decide the appeal dated 07.05.2021 (P-16) by passing a speaking order within a period of six weeks from the date of receipt of a copy of this order.

Present writ petition stands disposed of.
