Vide order dated 12.08.2024 notice was issued to the appellant. As per the office report the sole appellant remains unserved with the report that the partner of the firm, namely, Hari Kishan, is stated to have died. This is the only address which was given in the memo of parties as well as in the judgments and decrees of both the Courts. In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 2.

Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
