Through the instant petition filed under Section 438 Cr.P.C., the petitioner seeks anticipatory bail in case FIR No.144 dated 28.09.2014 registered under Sections 420, 465, 468, 471, 473 and 120-B of Indian Penal Code, 1860 at Police Station Dasuya, District Hoshiarpur (Annexure P-1).
Counsel for the petitioner has contended that allegation against the petitioner is that he was recruited in the Indian Army on the basis of fake Ration Card and other documents presented by him which showed him to be resident of village Lamin. He submits that the documents were prepared by Bhola Ram, Namberdar, village Lamin and the petitioner is being sought to be arrested on basis of the FIR, which was registered way back in the year 2014. CRM-M-20793 of 2021 {2} investigation, in pursuance to the interim protection granted by this Court, vide order dated 27.05.2021.
Upon instructions from SI Dilbag Singh, State counsel affirms this fact and submits that the petitioner is no longer required for custodial interrogation as the challan stands presented. In view of the above facts, but without commenting on the merits of the case, the present petition is allowed and the order dated 27.05.2021 granting interim bail to the petitioner is made absolute, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure.
