AJAY TEWARI, J (ORAL) Prayer is for grant of regular bail in case FIR No.152 dated 15.7.2015 under Sections 379-B IPC and 25/54/59 of the Arms Act, P.S Dera Bassi, District SAS Nagar.

Learned counsel for the petitioner contends that the petitioner is in custody since 15.7.2015 and that similarly situated co-accused has been granted the concession of bail.

Learned state counsel has not disputed the aforesaid facts. However, he points out that one mobile was recovered from the possession of the petitioner.

Without commenting upon the merits of the case and taking into account the fact that the co-accused of the petitioner has been granted bail and that the trial shall take long time to conclude, no useful purpose would be served by putting the petitioner behind the bars. Accordingly, the petitioner is ordered to be released on bail to the satisfaction of the CJM/Duty Magistrate, SAS Nagar, Mohali.

Petition stands allowed.
