This is third application filed by the petitioner for grant of regular bail pending trial in FIR No.13 dated 06.02.2018 registered under Sections 302, 427, 148, 149 IPC at Police Station Dera Baba Nanak, Police District Batala, District Gurdaspur.
On 31.10.2019, prayer for grant of regular bail was declined to the petitioner with following order:
"Prayer in the present petition is to grant regular bail to the petitioner in FIR No.13 dated 06.02.2018 registered under Sections 302, 427, 148, 149 of the Indian Penal Code at Police Station Dera Baba Nanak, Police District Batala, District Gurdaspur.
As per case of the prosecution, petitioner alongwith co-accused were travelling in two Bolero vehicles DEEPAK KUMAR BHARDWAJ 2020.07.16 13:33 I attest to the accuracy and integrity of this document
Criminal Misc. No. M-17226 of 2020 and had killed two persons by trying to give it a colour of motor accident. It has been recorded in the FIR that Bolero jeep had hit the Activa Scooter for the first time and the accused had thereafter put their vehicle in reverse gear and killed one of the deceased.
No doubt, petitioner is in custody since 1 year and 8 months, however, keeping in view the allegations made and the fact that prosecution has already recorded evidence of 8 witnesses out of total 26 proposed to be examined, this Court is of the considered view that the ends of justice would be met if learned trial Court is requested to conclude the trial within 6 months.
In view of the above, the present petition is disposed of."
Learned counsel for the petitioner admits that the prosecution has already concluded its evidence and the case is now fixed for defence evidence.
Keeping in view the aforesaid facts, this Court is not inclined to consider the prayer for grant of regular bail. However, the learned trial Court is requested to expeditiously dispose of the case. Disposed of.
