-1IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH Date of Decision: 30.04.2026 Johra and others ......Petitioners Vs.

Vijai Vardhan, IAS and others ......Respondents CORAM: HON'BLE MRS. JUSTICE SUDEEPTI SHARMA Present :

Mr. Vikram Punia, Advocate, for the petitioners. Mr. Harish Nain, AAG, Haryana, for the respondents. **** SUDEEPTI SHARMA J. (ORAL) 1.

Learned counsel for the petitioners contends that he was not aware that petitioners No.20 and 21 were in illegal possession of the land. He came to know the said fact after the filing of the reply by the respondents, therefore, he seeks to withdraw his power of attorney on their behalf.

2.

On oral request made by learned counsel for the petitioners, his power of attorney on behalf of petitioners No.20 and 21 is deemed to be withdrawn.

3.

The present contempt petition has been filed for deliberate and intentional disobedience of order dated 13.11.2019 passed by this Court in CWP-9512-2016, wherein the following order was passed:-

-2- "Be that as it may, counsel for the petitioner has submitted that once the validity of the order dated 27.03.2001, passed by the Assistant Collector Ist Grade, Gohana has been tested by authorities like Collector, Commissioner, High Court and the Hon'ble Supreme Court and the said order has been upheld, the private respondents cannot raise this issue that the question of title has not been decided or wrongly decided. We have heard learned counsel for the parties and after perusal of record, are of the considered opinion that this is one such case in which all efforts have been made by the private respondents to keep their possession on the land as huge as 384 acres, that too, in the NCR, District Sonepat regarding which eviction order was passed about 18 years back.

Thus, repelling the arguments raised by the counsel for the private respondents and keeping in view the totality of the facts and circumstances, we direct the official respondents herein to immediately start proceedings to take possession of the entire 384 acres of land about which the order of eviction has already been passed and attained finality. The needful shall be done by the official respondents No.1 to 6 within a period of 15 days from the date of receipt of the certified copy of the order. If the possession is not taken then the petitioner shall be entitled to file contempt petition against the official respondents in terms of the provisions of the Contempt of Courts Act, 1971. Petition is allowed."

4.

In compliance of the order dated 13.11.2019 passed by this Court in CWP-9512-2016, compliance affidavit dated 25.04.2026 of Manish Malik, District Development & Panchayat Officer, Sonipat, along with Annexures R-4/1 to R-4/7, has been filed on behalf of respondent No.4 in the Registry. The same is taken on record.

5.

A perusal of paragraph No.7 onward of the said compliance affidavit shows that order dated 13.11.2019 passed by this Court in CWP9512-2016 has been complied with.

-36.

In view of the above, since order dated 13.11.2019 passed by this Court in CWP-9512-2016, has been complied with, therefore, the present contempt is purged and rule stands discharged. 7.
