***** Rajan Gupta, J. (Oral) This is a petition filed under Section 439 Cr.P.C. seeking regular bail in a case registered against the petitioners vide FIR No.149 dated 15.03.2017 under Sections 302/34 IPC at Police Station Assandh, District Karnal.
Learned State counsel on instructions from ASI Padam Singh, has urged before the court that in the FIR no role has been attributed to the petitioners. Injuries to the deceased were caused by other accused, who are in custody. Petitioners have been incarcerated since 17.03.2017 and only 04 witnesses have been examined by the prosecution till now. Heard.
Keeping in view the role assigned to the petitioners, their period of incarceration and the fact that trial may take long time to conclude, no useful purpose would be served by detaining the petitioners during pendency of the trial.
