(ORAL) Through this petition, the petitioner seeks anticipatory bail in case bearing FIR No.441 dated 26.12.2020, registered under Section 21 of the NDPS Act, at Police Station Civil Lines, Sirsa. Vide order dated 25.05.2021 passed by this Court, the petitioner was granted ad interim pre-arrest bail and had been directed to join investigation.

On 17.08.2021, learned State counsel submitted that despite of the interim protection granted to the petitioner, he had not joined the investigation. Even none has appeared on behalf of the petitioner on the said day.

Same was the situation on 27.10.2021.

Even today, the position remains the same as neither anybody is representing the petitioner nor he has joined the investigation. Learned State counsel, on instructions from ASI Rattan Singh, submits that the petitioner has again not joined the investigation. AMAN JAIN 2021.12.13 16:49 I attest to the accuracy of this order

CRM-M-20727-2021 (O&M) -2Perusal of the record would show that despite availing the number of opportunities, the petitioner has not bothered to join the investigation.

The petitioner cannot be allowed to avail the interim protection at the costs of violations of the conditions laid therein. Therefore, the petitioner is no longer entitled to the interim protection.
