1 2 34 1415 * * * * Present : Mr. H. S. Batth, Advocate for the petitioner. Mr. Gurvir Sidhu, Assistant Advocate General, Punjab. The petitioner is seeking regular bail in FIR No.120 dated 07.09.2013, registered under Sections 302, 201 and 34 IPC Police Station Sarhali, District Tarn Taran. Learned counsel for the petitioner contends that the petitioner is in custody since 09.09.2013 and she is sister of the deceased and the only role given to her is that she had connived with her mother and others. It was urged that the petitioner was married and was living separately and the trial is taking time. Nirvail Singh @ Soni was missing for a number of days. It was suspected that he had been murdered by his family members and tenants in connivance with each other and had been buried by them in the courtyard. The dead body was recovered from a trunk embedded in the earth from the courtyard.

The family members and the tenant are facing trial. The petitioner is the married sister of the deceased. Police had got information and had reached the spot. The case is based on circumstantial evidence. It is stated that the petitioner is not residing in the house. She is in custody for over a period of two years. The trial will take long to conclude, the petition is allowed. The petitioner is directed to be released on regular bail on execution of adequate personal and surety bonds to the satisfaction of trial Court.
