The petitioner through instant petition under Article 226 of Constitution of India is seeking setting aside of order dated 15.01.2021 (Annexure P-9) whereby application of the petitioner seeking compassionate appointment has been rejected.

The father of the petitioner was working with respondent bank as Peon who passed away in harness in 2016. The petitioner in terms of policy of the respondent-bank applied for the compassionate appointment. The respondent-bank without notice and without granting opportunity of hearing has rejected application of the petitioner. 3.

Learned counsel for the petitioner submits that respondentbank has passed impugned order in a mechanical manner. No ground has been set out in the impugned order. From the impugned order, ground of ANJU GOEL 2023.09.14 18:28 I attest to the accuracy and integrity of this document

CWP-7506-20233 -22023:PHHC:121168 rejection of application of the petitioner cannot be ascertained. The petitioner was not heard, thus, order has been passed in gross violation of the principle of natural justice.

Learned counsel for the respondents expressed his inability to controvert the fact that impugned order is a non-speaking order and it has been passed without granting opportunity of hearing. 6.

In the wake of statements of learned counsel for the parties, the impugned order dated 15.01.2021 stands set aside with a direction to pass afresh order after granting opportunity of hearing to the petitioner. Needful shall be done within three months from today.
