The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.195 dated 31.10.2017 registered for the offences under Section 392 and ( Section 395 IPC, which was added later on) at Police Station Division No.3, Jalandhar, District Jalandhar.
I have heard learned counsel for the petitioner and have gone through the record.
As per the prosecution version, the FIR was registered on the statement of complainant Montu Gill, who levelled specific allegations against the accused that on 14.10.2017, he had gone to Partap Bagh to collect money and was talking with Anil Kumar. In the meantime, 6-7 persons out of them two were Sikhs and other were clean shave persons, came there, who were armed with pistol, kirpan and Datar and the one clean HARPAL SINGH PARMAR 2019.04.12 16:57 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-16594 of 2019 [2] shave person took out `57,000/- from the pocket of his pant on the pistol point and threatened him not to inform the Police and fled away from the spot. Tajinder Pal Singh alias Sher Singh Babbar, who was arrested by the Police on 2.11.2017, during investigation suffered confessional statement before the Police nominating the present petitioner also. Keeping in view the above facts, I find that the petitioner is required for custodial interrogation, therefore, I do not find it a fit case where the petitioner is entitled for the grant of anticipatory bail. Hence, finding no merit in this petition, the same is dismissed. April 11, 2019.
