The petitioner is seeking regular bail in FIR No.112 dated 31.05.2017, under Section 306/506 IPC, registered at Police Station City Kharar, District SAS Nagar Mohali.

Learned counsel for the petitioner contends that the allegations against the petitioner in the FIR are that he was allegedly having an affair with the wife of the deceased due to which the deceased committed suicide. He further contends that the deceased himself had filed a petition to divorce his wife on 09.05.2017 while he committed suicide on 30.05.2017. He also contends that allegations in the FIR do not prima facie constitute an offence under Section 306 IPC as the essential ingredients are not made out. Learned counsel for the State on instructions from ASI Avtar Singh states that investigation has been completed and challan has been filed before the competent Court on 14.08.2017. CRM-M-32690-2017 -2The allegations against the petitioner are that he was having an affair with the wife of the deceased while the deceased had already filed a petition to divorce his wife. The petitioner is in custody for over 3 months since his arrest on 31.05.2017 and the investigation has been completed, therefore, I find it appropriate to allow him the concession of regular bail. In view of the aforementioned facts and circumstances and without expressing any opinion on the merits of the case, the instant petition is allowed. Petitioner Parvinder Singh is ordered to be released on bail on his furnishing bonds to the satisfaction of trial Court/Duty Magistrate. The petition stands disposed of.
