Learned State counsel, on instructions from ASI Mukhtiar Singh, states that pursuant to the order passed by this Court, dated 25.5.2021, the petitioner has joined the investigation and got twenty seven items, including gold and silver jewellery, TV sets, wrist watches and other furniture items, recovered. This has also been mentioned in the reply dated 16.11.2021, filed by the Deputy Superintendent of Police, Ludhiana. He further states that some of the jewellery items and some cash amount remain to be recovered from the petitioner. Mere pending recovery of some of the alleged dowry articles is no ground to deny pre-arrest bail to the petitioner. It is a matter of trial as to whether dowry has been given, and in whose custody the articles are. In view thereof, the present petition is allowed.
