(Oral) The petitioner has approached this Court seeking grant of regular bail in a case having FIR No.62 dated 26.2.2021 registered under Section 17 of NDPS Act at Police Station Sadar District Sirsa. As per the allegations in the FIR the petitioner was arrested along with 2.100 Kgs of Opium by the police on 26.2.2021. The aforesaid contraband comes under non-commercial quantity as per the provisions of NDPS Act. As has been stated by the State counsel, after completion of investigation challan has been presented and charges are framed as well as no other criminal case is pending against the petitioner. ( 2 ) CRM-M-20879-2021 will take time for termination of the trial. The strict provisions of Section 37(1)(b) of NDPS Act are not applicable to the case in hand. So no purpose is going to be served by keeping the petitioner in custody for any longer period. Thus without commenting on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail and surety bonds to the satisfaction of the CJM/Duty Magistrate concerned.
