**** HARNARESH SINGH GILL, J.(Oral) Through this second petition, the petitioner seeks regular bail in case bearing FIR No.5 dated 09.06.2020, registered at Police Station SSOC Fazilka, District Fazilka, under Sections 21, 23 and 30 of the NDPS Act.
At the outset, learned counsel for the petitioner restricts his arguments for grant of interim regular bail to the petitioner on medical ground.
Learned counsel for the petitioner submits that the petitioner is suffering from acute leukemia and chronic myeloid leukemia in blast crisis, as would decipher from the report dated 16.06.2022 issued by Department of Pathology.
Short affidavit dated 01.08.2022 of the Superintendent Central Jail, Ferozepur, filed on behalf of the respondent-State, in the Court, is taken on record.

CRM-M-19575-2022 (O&M) -2As per the medical status report dated 01.08.2022 issued by the Medical Officer, Central Jail, Ferozepur, the petitioner was admitted to the hospital with complaint of general body weakness and body ache. Upon examination, the petitioner was referred Civil hospital Ferozepur and thereafter to GGSMCH, FDK, where his bone marrow biopsy was done on 16.06.2022 and he was diagnosed with blast crisis and acute leukemia. Now the petitioner is to be referred to PGIMER, Chandigarh for further treatment.
In view of the above, without going into the merits of the case and taking into consideration the medical condition of the petitioner, the petitioner is ordered to be released on interim regular bail for a period of three months from the date of his release, on execution of the bail/surety bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate concerned.
