Petitioners Baldev Singh and Karamjit Singh have filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.182 dated 10.08.2015 under Sections 406, 420, 408 and 120B IPC registered at Police Station Dera Bassi, District S.A.S. Nagar, Mohali.
Notice of motion was issued and learned State counsel appeared and contested the petition.
I have heard learned counsel for the petitioners as well as learned State counsel and have gone through the record. From the record, I find that present petitioners are named in the FIR and the allegations are levelled against them regarding VINEET GULATI 2015.11.17 10:35 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-32758 of 2015 -2embezzlement of huge amount of Truck Union for their personal benefit.
After hearing learned counsel for the petitioners as well as learned State counsel and after going through the record as well as police file, I find that there are entries of lacs of rupees regarding withdrawing the amount from the account of Truck Union and further statements of so many witnesses have been recorded that amount has not been paid to the truck operators, rather amount has been embezzled etc.
Keeping in view the nature and gravity of the offence and as argued by learned State counsel, I find that petitioners are required for custodial interrogation.
Therefore, finding no merit in the present case, the same is dismissed.
