Present petition under Section 482 Cr.P.C is for quashing of order dated 30.1.2017, passed by learned Judicial Magistrate Ist Class, Ludhiana.

Learned counsel for the petitioner contended that statement (Annexure P5) tantamounts to confessional statement and requisite statement as recorded under Section 164 Cr.P.C. cautioning the author to make or not to make such a statement.

The statement (Annexure P5) is considered and the same is simply admission of accepting liability in a case under the Negotiable Instruments Act, 1881 and the same was relied upon by the learned Court below and there was absolutely no reason for the Court not to rely upon or to pass some order on the basis of such a statement and the orders passed by both the Courts below do not require any interference.
