The petitioner has been in custody since 29.1.2014 for having been found in possession of 160 kgs of poppy husk, whereas 140 kgs of poppy husk was recovered from co-accused Soma. The petitioner was arrested from the spot. Six out of ten prosecution witnesses have been examined whereas the petitioner is in custody for the last about 2 years. The petition is disposed of with a direction that the trial court shall make an earnest endeavour to examine all the prosecution witnesses within a period of four months after the next date of hearing, fixed before it. It is further ordered that in case the prosecution agency is unable to produce all the prosecution witnesses within a period of four months after the next date of hearing, the petitioner shall be released on bail on his furnishing bail bonds/ surety bonds to its satisfaction.
