**** HARNARESH SINGH GILL , J. (ORAL) Case is taken up for hearing through video conferencing. The petitioner seeks regular bail in FIR No. 21 dated 25.1.2021 under Sections 307, 341, 353, 186, 427, 506, 148, 149 IPC and Sections 25 and 27 of the Arms Act, 1959 registered at Police Station Samrala, Ludhiana, District Ludhiana.

Custody certificate by way of affidavit of Deputy Superintendent, Central Prison, Ludhiana has been filed through e-mail. Copy of the same is taken on record.

Learned counsel for the petitioner submits that in the present case, no injury has been attributed to the petitioner; that in the FIR, it is GURPREET SINGH 2021.06.29 16:07 I attest to the accuracy and integrity of this document Chandigarh alleged that the petitioner was armed with a kirpan but the petitioner is

CRM-M No. 20876 of 2021 -2stated to have fired a shot towards the complainant when he was in process of leaving the spot; that the co-accused has been granted interim bail by a Co-ordinate Bench of this Court on 18.6.20201; and that the petitioner has been in custody since 1.5.2021.

On the other hand, learned State counsel submits that there are specific allegations against the petitioner but has not denied the fact that no injury has been attributed to the petitioner and the shot was fired in the air only.

As per the custody certificate, the petitioner has been in custody for the last 01 month and 22 days. Co-accused Sandeep Singh alias Seepa has already been granted interim bail by a Co-ordinate Bench of this Court on 18.6.2021. The trial will take time to conclude because of Covid-19 pandemic. No useful purpose would be served by keeping the petitioner behind the bars.

Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
