*** DEEPAK GUPTA, J. (ORAL) On 13.04.2023, following order was passed:- "Prayer in this petition under Section 438 Cr.P.C. is for grant of anticipatory bail in case FIR No.476, dated 06.10.2022, registered at Police Station City Tohana, District Fatehabad, under Section 307 IPC, besides Section 25 and 27 of the Arms Act, 1959 (later on Section 27 of the Arms Act was deleted and Section 307/120B IPC was added).
As per allegations, on 05.10.2022 an unknown person with an intention to kill, fired upon Khushi Ram S/o Tek Chand working as a Compounder with Dr. Sunil Sethi. The attribution to the petitioner is that co-accused had taken shelter from the petitioner, who had provided facilities to them.
Learned counsel for the petitioner has pointed out that two coaccused, namely Sunny @ Sudama and Krishan @ Kachhu have already been allowed regular bail by this Court vide order dated 03.02.2023 and 16.02.2023 passed in CRM-M-4815-2023 and CRM-M-7469-2023 respectively. Adjourned to 04.07.2023 for filing status report. In the meantime, petitioner is directed to join investigation and co-operate in the same. He will not leave the country without prior permission of the Court nor shall make any attempt to contact the complainant of the case or any witness associated with the case. In the event of the arrest of the petitioner, he shall be released on interim bail on his furnishing personal/surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. He shall also abide by conditions as envisaged under Section 438(2) Cr.P.C."
