As per the report of the Registry, the notice issued to the sole appellant-department stands received back duly served through the office clerk.

A perusal of the case file reveals that on the last date of hearing, i.e. 25.09.2025, neither the appellant nor any counsel on his behalf appeared before this Court. It is further evident from the report of the Registry that the notice has been duly served upon the sole appellantdepartment through the office clerk. It is, therefore, surprising that despite due service, no one has put in appearance on behalf of the sole appellantdepartment, nor have any steps been taken either by the learned counsel for the appellant or by the appellant-department itself. 3.

In the aforesaid circumstances, it is evident that no useful purpose would be served by keeping the present appeal pending on the docket for an indefinite period.

It, therefore, appears that the appellant is not interested in prosecuting the present appeal.

Accordingly, the present appeal is dismissed in default for want of prosecution.

However, liberty is granted to the appellant to seek revival of the appeal in accordance with law, in case any worthwhile cause survives for consideration.

Pending application(s), if any, shall also stand disposed of. 8.

A copy of this order be forwarded to concerned Deputy Commissioner for necessary information.
