**** JAISHREE THAKUR, J. (ORAL) This is a petition that has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case FIR No. 58 dated 01.12.2016 registered under Sections 498-A, 406 IPC at Police Station Women Cell, SAS Nagar.

This Court was pleased to pass the following order on 06.09.2017 :- "Heard.

This is a petition that has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in FIR No.58 dated 01.12.2016, registered under Sections 498-A, 406 of Indian Penal Code at Police Station Women Cell, SAS Nagar. While praying for grant of interim bail, counsel for the petitioner submits that five other members of the family of the petitioner, who have been named in the FIR, are already participating in the mediation proceedings before the Mediation Cell at Mohali, in which the next date is 12.09.2017. Notice of motion for 22.01.2018.

CRM-M-32809-2017 -2Meanwhile, in the event of arrest, the petitioner be released on interim bail subject to his furnishing personal bonds and surety to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438 (2) Cr.P.C. "

As per the report of the Mediator, both the parties have settled their dispute by way of settlement/agreement. Mr. A.S. Sandhu, learned Addl. A.G., Punjab confirms the factum of compromise before the parties.

I have heard learned counsel for the parties. Keeping in view the fact that the parties have settled their dispute amicably, the petition is allowed and interim order dated 06.09.2017 is hereby made absolute subject to the condition that the petitioner will not tamper with evidence or hamper the investigation; will not leave India without permission of the Court and will comply with the conditions contained in Section 438(2) Cr.P.C.
