(proceedings conducted through video conferencing) ***** GURVINDER SINGH GILL, J.(Oral) Having heard the learned counsel for the petitioner and while refraining from making any expression as regards merits of the case or as regards averments made in the petition, the petition is disposed of with a direction to respondent No.4-Commissioner of Police, Jalandhar to look into the matter and to ensure that the matter pertaining to FIR No.15 dated 31.1.2021 registered at Police Station Basti Bawa Khel, District Jalandhar under Sections 307, 120-B, 148 and 149 of Indian Penal Code is got investigated expeditiously in accordance with law, so that a final report is submitted thereafter at the earliest.

It is further directed that during the course of investigation the Investigating Officer shall examine all such evidence/documents/ PANKAJ KAKKAR 2021.07.06 18:46 I attest to the accuracy and integrity of this document

( 2 ) CRM-M-20888-2021 (O&M) photographs/CCTV footage as may be produced by the petitioner so as to examine the veracity of the allegations made by the complainant as it has specifically been asserted before this Court that even in the CCTV footage the presence of the petitioner is nowhere reflected. The Investigating Officer is specifically directed to examine the plea of alibi as is being pleaded by the petitioner to the effect that on 31.1.2021 the petitioner was infact not even present in Jalandhar City and was away to Ludhiana to meet his friends Rahul Sharma and Bhupinder Singh, who are having their office outside Bus Stand, Ludhiana and had returned back to Jalandhar only late at night i.e. 1010:30 p.m. on 31.1.2021. Respondent No.4-Commissioner of Police, Jalandhar to monitor the investigation specifically pertaining to the plea of alibi. A copy of this order be sent to respondent No.4-Commissioner of Police, Jalandhar and to respondent No.5-S.H.O. Police Station Basti Bawa Khel, District Jalandhar so as to enable them to do the needful expeditiously.
