After availing as many as eight opportunities to file the written statement in a period spanning over one year, the defence of the defendants was struck off by the Court vide order dated 15.01.2019. The petitioners have challenged the correctness of the aforesaid order. 2.

No doubt, normally, the Court takes a liberal view because the aforesaid provision is not mandatory. However, the Court cannot come to the rescue of a person who intentionally delayed the decision of the suit. It is evident that the petitioners appeared through their counsel on 05.01.2018 whereas their defence was struck off on 15.01.2019. 3.

Keeping in view the aforesaid facts, no ground is made out to interfere. Consequently, the present revision petition is dismissed. (Anil Kshetarpal) Judge May 10, 2022 "DK"
