The petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.14 dated 9.1.2015 registered for the offence under Section 21 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as `the Act') at Police Station City Ferozepur, District Ferozepur.

Notice of motion to Advocate General, Punjab. Mr. Kuldeep Singh, learned Senior Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. Harpal Singh Parmar 2017.09.29 16:37 I attest to the accuracy and authenticity of this document Chandigarh

No.M-32852 of 2017 [2] From the record, I find that in the present case prosecution evidence has already been closed as submitted by the learned State counsel and the case is fixed for recording the statement of the accused under Section 313 Cr.P.C. Therefore, the trial is almost complete. Learned counsel for the petitioner argued that the petitioner has been picked-up by the Police earlier to the occurrence as shown by the prosecution and has been falsely implicated in this case. The petitioner is at liberty to lead the evidence before the trial Court and this fact will also be determined on the basis of evidence before the trial Court. As the trial is almost complete, therefore, in the facts and circumstances of this case, I do not find it a fit case where the petitioner is entitled to the benefit of regular bail.

Therefore, finding no merit in this petition, the same is dismissed.
