Through this revision under Article 227 of the Constitution of India, prayer has been made for setting aside impugned order dated 18.02.2020 (Annexure P-2) of the Executing Court, whereby LRs of petitioner and proforma respondents No. 5 to 11 are directed to furnish indemnity bond for the compensation amount to be disbursed to them. Petitioners are feeling aggrieved by the condition imposed by the Executing Court for furnishing indemnity bonds of the amounts to be disbursed to them.

CR-1966-2020 -2At the outset, learned counsel for the petitioner(s) submits that case of the petitioner(s) is squarely covered by judgments of this Court dated 08.11.2017 and 29.08.2019 (Annexures P-3 and P-4) passed in CR-7418-2017 and CR-4660-2019 and other connected cases, respectively.
Learned State counsel fairly conceded that case of petitioner(s) is squarely covered by the judgments Annexures P-3 and P-4 and he has no objection in case, the instant revision is allowed. In view of the above, the instant revision is accepted in toto and the Executing Court is directed to release the amount which is due to the petitioner-revisionists and proforma respondents No. 5 to 11, without asking them for furnishing of indemnity bond.
