**** HARNARESH SINGH GILL , J. (ORAL) CRM-14718-2020 Case is being taken up for hearing through video conferencing. This is an application for grant of exemption from filing the attested copy of affidavit, original copies of annexures, Court fee and power of attorney.

For the reasons mentioned in the application, the applicantpetitioner is granted exemption from filing the attested copy of affidavit, original copies of annexures and power of attorney. However, learned counsel for the petitioner is directed to deposit the Court fee online forthwith.

The application stands disposed of.

CRM-M No. 17071 of 2020 (O&M) -2under Section 22 of Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station Sadar Jalandhar, Police Commissionerate Jalandhar.

Learned counsel for the petitioner submits that petitioner has been in custody since 21.3.2019 and the evidence has not commenced yet. He further submits that 220 intoxicant capsules were recovered from the petitioner and co-accused and the recovery is marginally higher than the commercial quantity. Learned counsel also points out that the petitioner was earlier granted interim bail by the trial Court vide order dated 16.5.2019 awaiting the FSL report and the petitioner has not misused the concession of bail and surrendered within the stipulated period. Notice of motion.

On the asking of the Court, Mr. Ajay Pal Singh Gill, DAG, Punjab accepts notice on behalf of the State. He points out that the petitioner has undergone 01 year and 26 days of custody and there is no other case pending or decided against him.

The petitioner has been in custody since 21.3.2019. The evidence has not started yet. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars. Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
