(Oral) The petitioner - Rohit Kumar has filed the instant petition under Section 438 Cr.P.C. for grant of anticipatory bail in FIR No.79 dated 09.04.2022 under Section 498-A IPC registered at Police Station Women Cell, Ludhiana.

As per the facts of the case Lovepreet Kaur filed written complaint against her husband and in-laws family, alleging that she got married with Rohit Kumar on 18.08.2021 as per Hindu Rites. She had performed marriage against the wishes of her parents. Initially, their relationship was cordial but thereafter, the complainant was harassed by her husband and even gave beating to her under drunkard condition. All the accused mentioned in the FIR maltreated her. She further came to know that accused no. 1 was having illicit relations with accused no. 11.

CRM-M-18950-2022 -2The accused no. 1 was addicted to intoxicants and he even had stolen money from the house. Ultimately, the complaint was filed with the police and the present FIR has been registered against her husband. Learned counsel for the petitioner argued that he was granted interim anticipatory bail as per order dated 13.07.2022. He has joined the investigation. He also deposited money as per the directions of Court. He is still ready to join the investigation. Therefore, the interim anticipatory bail may be confirmed.

Learned counsel representing the State pointed out that as per ASI Meet Ram, the petitioner has already joined the investigation and he is not required for any purpose.

I have considered the arguments and have gone through the record carefully. The petitioner was granted ad-interim bail as per order dated 13.07.2022 and during this period, he has joined the investigation. It is a case under Section 498-A IPC. No recovery is to be effected. As the petitioner has already joined the investigation, therefore, the ad-interim bail granted in favour of the petitioner is confirmed, subject to the conditions envisaged under Section 438(2) Cr.P.C. The petition is disposed of.
