The petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.138 dated 14.9.2006 registered for the offences under Sections 326, 324, 506 and 34 IPC at Police Station Noormahal, District Jalandhar.
Notice of motion to Advocate General, Punjab. Mr. A.P.S. Gill, learned Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the FIR in this case is of 2006. Harpal Singh Parmar 2017.09.29 16:37 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-32897 of 2017 [2] Earlier the petitioner absented from the Court proceedings in the year 2008 and he was declared proclaimed offender vide order dated 8.1.2009. He surrendered before the Court only on 6.4.2017 after 8 years. After the bail was granted to the present petitioner, there is every chance that he may again abscond. Therefore, no ground is made out for grant of bail to the petitioner.
However, the trial Court is directed to expedite the trial of the case and dispose of the same preferably within three months by giving short adjournments and if required by giving day to day adjournments. The Investigating Officer and S.H.O. of this case are directed to produce the witnesses on the next two-three dates.
