Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.220 dated 28.02.2018 under Sections 279, 336, 307 IPC, Section 25 of the Arms Act and Section 13(1), of Haryana Gausanrakshan and Gauvardhan Act and Section 11 of Prevention of Animals to Cruelty Act, registered at Police Station Chandni Bagh, Panipat.

Mr.Sukhdeep Parmar, DAG, Haryana, has put in appearance on behalf of the respondent-State and contested the petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the petitioner is not named in the VINEET GULATI 2018.08.14 16:50 I attest to the accuracy and authenticity of this document Chandigarh FIR. As per prosecution version, petitioner was nominated in this case and
CRM No.M-33832 of 2018 -2he was stated to be armed with pistol. Though, petitioner fired from the pistol but it is a case of no injury.
The petitioner has been in custody since 03.05.2018. He is not required for investigation or interrogation purposes as he is in judicial custody. Challan has already been presented. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the disposal of the case.
Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal/surety bonds in the sum of `50,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
