*** The case has been taken up through Video Conferencing. This petition for regular bail has been filed by petitioner Satya Parkash Singh son of Sh. Mritunjay Singh, aged 21 years, resident of H.No. 790, Babu Budha Ji Nagar, Basti Mithu, Jalandhar, an accused in F.I.R. No. 36 dated 26.2.2021, registered with Police Station Basti Bawa Khel, Police Commissionerate Jalandhar for offences under Sections 379-B, 341, 34 IPC.

Briefly stated the prosecution story is that on 21.2.2021 at about 5.30 P.M., complainant Amarjit Kumar along with his co-brother was returning from Fish Market on a bicycle and while they were in the area of small bridge at Shaheed Babu Labh Singh Nagar within jurisdiction of Police Station Basti Bawa Khel, Police Commissionerate Jalandhar, then three young boys riding on Activa scooter came from behind and stopped bicycle of complainant. They caught hold of him from his neck and threw

away his bicycle. One of them took out purse from trouser of the complainant. That purse contained currency notes worth Rs.4800/-, two Aadhar Cards and RC of Pulsar motorcycle. Thereafter they ran away towards Shaheed Babu Labh Singh Nagar on Activa scooter, grey in colour bearing registration number PB-08-DT-0558. The name of one of the culprits came to be known as Satya Parkash Singh (present petitioner). On intimation being given to the police, formal F.I.R. was registered in the matter. The accused was arrested in this case on 26.2.2021. He is in judicial custody. The challan against him is said to have been filed and charge is yet to be framed. His co-accused Sunny and Raja are yet to be arrested. Though the petitioner is said to be involved in another criminal case but he is stated to be on bail in the said case. The conclusion of trial is likely to take some time especially since the working in the Courts has been effected on account of outbreak of Covid-19. His guilt shall be determined during the trial.

Keeping in view the totality of circumstances, I find that the petition deserves to be accepted and it is hereby allowed. Petitioner Satya Parkash Singh is ordered to be released on bail on his furnishing bail bond and surety bond to the satisfaction of the learned trial Court/CJM/Duty Magistrate, Jalandhar subject to the following conditions :- (i) he shall appear in the Court on each and every date of hearing.

(ii) he shall not give any threat or intimidation to the prosecution witnesses.

(iii) he shall not leave India without prior permission of the Court and shall surrender his Passport, if he has got one, otherwise to furnish affidavit in that regard.

(iv) he shall not indulge in any criminal activity.

(v) he shall got his presence marked in the local police station on every Saturday of the week between 11.00 A.M. to 2.00 P.M. so that an eye can be kept on his movements and he is deterred from indulging in any criminal activity.

In case the petitioner violates any term and condition on which the bail has been granted to him, the prosecution would be entitled to apply for cancellation of bail.
