Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.78 dated 30.05.2017 under Sections 120-B, 420 and 406 IPC (Sections 467, 468 and 471 IPC added later on), registered at Police Station Baragudha, District Sirsa. Notice of motion.
Mr.B.S.Virk, DAG, Haryana, has put in appearance on behalf of the respondent-State and contested the petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As per the allegations, present petitioner entered into an agreement to sell with the complainant and received an amount of `11,25,500/- and he also entered into agreement to sell with two other VINEET GULATI 2018.08.14 16:43 I attest to the accuracy and authenticity of this document Chandigarh persons and received earnest money from them also.
CRM No.M-33880 of 2018 -2Challan has already been presented and charges have already been framed against the petitioner, as argued by learned State counsel. The petitioner has been in custody since 23.12.2017. He is not required for investigation or interrogation purposes as he is in judicial custody. He is only to face trial. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the disposal of the case.
Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal/surety bonds in the sum of `50,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
