ANIL KSHETARPAL, J (ORAL) As per office report, notice issued to respondent No.1 has been received back served whereas respondent No.2 has refused to accept notice, hence service of notice is complete.

Through this transfer application, the petitioner (respondent No.1's wife) prays for transfer of case bearing No.HMA/516/2023 titled as "Kuljinder Singh Vs. Davinder Kaur and Another" from the court of Principal Judge, Family Court, Moga to the court of competent jurisdiction at Ludhiana. While alleging that she is taking care and has custody of small daughter aged about two and half years and she does not have wherewithal to contest the petition at Moga because she is presently residing and dependent upon her parents, she has filed this petition.

Aforesaid assertions have not been rebutted.

Hence, the application is allowed. Petition bearing HMA/516/2023 titled as "Kuljinder Singh Vs. Davinder Kaur and Another" is transferred from the court of Principal Judge, Family Court, Moga to the court of competent jurisdiction at Ludhiana.
