An advertisement for 3038 posts of Constable (male & female) was issued on 01.03.2010. Petitioner was one of the applicants. He claims that he underwent physical efficiency test as well as interview. His name figured at serial no. 1 in the waiting list. His plea is that in the month of May, 2018, he happened to meet one Devinder Singh who informed him that he (Devinder Singh) had never joined pursuant to the selection. On getting this information, petitioner moved application under the Right to Information Act to inquire about this fact. He received communication dated 30.07.2018, Annexure P-2, according to which all candidates who were selected had joined. According to him, wrong information has been supplied to the petitioner by the authorities as he is in touch with the Devinder Singh who did not join.

Thus, petitioner acquired a right to be appointed. In my considered view, present petition is totally frivolous. It appears that selection pursuant to advertisement was made in the year 2010. Petitioner has made certain averments in support of which no evidence is available. Besides, petition suffers from serious delay and laches. It has no AJAY KUMAR 2019.04.

CWP No. 9604 of 2019 where been explained why petitioner kept quite for eight years and did not move any application under the Right to Information Act earlier to elicit the same information which he appears to have sought now.
