CHANDIGARH 208-B CRM-M-19260-2022 (O&M) Date of Decision: 18.07.2022 KULWANT KUMAR @ KALU ... Petitioner
Versus
STATE OF PUNJAB ... Respondent CORAM: HON'BLE MR. JUSTICE HARNARESH SINGH GILL
Present:
Mr. HS Bhogal, Advocate for the petitioner.
Mr. Ajay Pal Singh Gill, DAG Punjab.
**** HARNARESH SINGH GILL, J.(Oral) Through this petition, the petitioner seeks anticipatory bail in case bearing FIR No.110 dated 18.07.2021, registered under Sections 15(c) of the NDPS Act, at Police Station City Garh Shankar,District Hoshiarpur.
Vide order dated 07.05.2022 passed by a Coordinate Bench of this Court, the petitioner had been granted ad interim anticipatory bail and directed to join the investigation.
Learned counsel for the petitioner submits that in compliance of the aforesaid order, the petitioner had joined the investigation.
On the other hand, while opposing the prayer for grant of anticipatory bail to the petitioner, learned State counsel, on instructions from ASI Kaushal Chander, submits that the petitioner is a person of AMAN JAIN 2022.07.19 16:32 I attest to the accuracy and authenticity of this order/judgment
208-B CRM-M-19260-2022 (O&M) -2criminal antecedents, inasmuch as, there are five more more FIRs under the NDPS Act, against the petitioner. He, thus, prays for dismissal of the present petition.
I have heard the learned counsel for the parties. Though, in compliance with the order dated 07.05.2022 passed by the Coordinate Bench, the petitioner is stated to have joined the investigation, yet the fact remains that there are five more FIRs under the NDPS Act registered and/or pending against the petitioner. The possibility of the petitioner's involving himself in similar crime again, if granted the concession of anticipatory bail, cannot be ruled out. Thus, the criminal antecedents of the petitioner do not entitle him for any further concession of anticipatory bail.
In view of the above, no ground is made out to grant further concession of anticipatory bail to the petitioner. Dismissed.
