**** HARSIMRAN SINGH SETHI , J. (ORAL) This petition has been taken for hearing through video conference due to Covid-19 pandemic.
Present petition has been filed under Section 439 Cr.P.C. for the grant of regular bail to the petitioner in FIR No.161 dated 03.08.2015, under Sections 302, 307, 325, 341, 506, 148, 149 and 120-B IPC, registered at Police Station Sadar, Jagraon, District Ludhiana. Learned State counsel has furnished the custody certificate of the petitioner, which is taken on record.
As per the averments made in this petition, petitioner had filed a bail application before the learned Additional Sessions Judge, Ludhiana alongwith other co-accused, namely, Dhanna Singh and the same was rejected on 27.10.2016. Thereafter, co-accused of the
CRM-M-17228-2020 -2petitioner, namely, Dhanna Singh filed CRM-M-39479-2016, seeking grant of regular bail, which petition was withdrawn on 16.11.2016. Dhanna Singh (co-accused of the petitioner) again filed CRM-M-11122-2017 seeking concession of bail, which petition was again dismissed by this Court on 19.04.2017. Once again, Dhanna Singh (co-accused of the petitioner) approached this Court for the grant of regular bail by filing CRM-M-28529-2018, which was also dismissed on 18.07.2018.
Learned counsel for the petitioner has not been able to dispute the allegations alleged against the petitioner and co-accused Dhanna Singh are similar. The similar request of the grant of bail, moved by co-accused Dhanna Singh, has already been rejected by this Court more than once. Further, this Court while rejecting the bail petition of coaccused, has already given direction to the trial Court on 18.07.2018 to expedite the trial.
Keeping in view the gravity of the allegations alleged against the petitioner and especially that the trial is in the final stages, no ground is made out qua grant of bail to the petitioner and the present petition is accordingly dismissed.
However, it is made clear that anything observed herein shall not be construed to be an expression of any opinion on the merits of the case.
