The petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.13 dated 25.3.2015 registered at Police Station Jhunir, District Mansa for the offence under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as `the NDPS Act').

Notice of motion to Advocate General, Punjab. On the asking of the Court, learned Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.

I have gone through the record and have heard learned counsel for the petitioner and learned Deputy Advocate General, Punjab appearing HARPAL SINGH PARMAR 2015.10.06 17:41 I attest to the accuracy and authenticity of this document Chandigarh

As per the prosecution version, tablets containing Alprazolam salt have been recovered from the accused which falls in the commercial quantity as the total quantity will come to 109 Grams and more than 100 Grams is commercial quantity. Therefore, bar of Section 37 of the NDPS Act will apply in this case and I do not find it a fit case to grant bail to the petitioner.

Therefore, in view of the above discussion, I do not find any merit in this petition and the same is dismissed. September 30, 2015.
