NIDHI GUPTA, J. (ORAL) Prayer in this 1st petition filed under Section 439 Cr.P.C., is for grant of regular bail to the petitioner in case FIR No.316 dated 22.09.2023 registered under Sections 365 IPC (Sections 6 and 17 of the Protection of Children from Sexual Offences Act, 2012 and Section 363, 366-A IPC were added later on) at Police Station Chhappar, District Yamuna Nagar..
Learned counsel for the State has filed custody certificate dated 19.04.2024, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 04 months and 14 days.
After arguing for sometime, when this Court is not inclined to accord the benefit of regular bail to the petitioner, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition, at this stage.
Permitted to do so.
