A perusal of the FIR reveals that it is a quashing petition on merits. However, once the respondent/complainant has agreed for quashing of FIR, as such, liberty is reserved to the petitioners to file a fresh petition for quashing of FIR on the basis of compromise.
Given above, the petitioners are directed to file a fresh petition for quashing of FIR based on compromise, since, there is no objection on behalf of respondent No. 2Arun Kumar. In case, respondent No. 2-Arun Kumar resiles from the compromise, it shall again be permissible for the petitioners to file a fresh petition for quashing of FIR on merits along with additional fact that respondent No. 2 had not objected for quashing of FIR. The present petition stands disposed of. All pending miscellaneous applications, if any, stand disposed of.
Further liberty is reserved either to file a fresh petition for quashing of FIR on compromise or quashing on merits by arraigning all the aggrieved persons as accused.
