******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.117 dated 05.05.2017 registered for the offences punishable under Section 379-A of Indian Penal Code (for short, "IPC") at Police Station Ambala Cantt. District Ambala.

Heard.

Learned counsel appearing for the complainant submits that the matter has since been amicably settled with the petitioner and a petition CRM-M-37641-2017 seeking quashing of instant FIR on the basis of compromise has also been filed in which parties have been directed to appear before the trial Court and get their statements recorded. Learned State counsel submits that the investigating officer of the case is not aware of the compromise. After completion of investigation challan has been presented in Court and charges have also been framed Jitender Kumar 2017.10.27 15:33 I attest to the accuracy and integrity of this document CHANDIGARH

Keeping in view the fact that parties have entered into compromise, the present petition is allowed. Petitioner-Baljeet Singh is ordered to be released on regular bail on furnishing bail bond and surety bond to the satisfaction of concerned trial Court/Chief Judicial Magistrate/Duty Magistrate, subject to following terms:- (a) The petitioner shall comply with the conditions mentioned in Section 437(3) Cr.P.C.

(b) In the event of his absence on any date of hearing, the benefit of bail allowed to the petitioner shall stand withdrawn. The trial Court shall be competent to cancel his bail bond and surety bond and proceed to procure his presence in accordance with law. In that eventuality the petitioner shall have to apply for bail afresh. (c) He shall not leave the country without the previous permission of the Court.
