MADAAN Present:- Mr. Rishabh Gupta, Advocate for the petitioner. *** Petitioner Gurvinder Singh is aggrieved by the order dated 18.5.2018 passed by Judicial Magistrate, Hoshiarpur restoring petition under Section 125 Cr.P.C. filed by Narinder Kaur and two minor children. The application for restoration has been filed by two of the petitioners both of them being minors i.e. minor daughter and minor son.

I have gone through the impugned order. I do not find any illegality or infirmity therein. It is always desirable to decide a lis on merits rather than non suiting a litigant on technical grounds. The revisionist can contest those proceedings by filing written reply, cross examining the witnesses produced by the petitioners and leading evidence. He is unnecessarily aggrieved by that order. There is no merit in the petition, therefore, the same stands dismissed.
